LEGISLATIVE UPDATE 2003
AB 1847
Adds an illness due to expose to a biochemical substance is presumed to arise out of and in the course of employment for peace officers and fire fighters.
AB 1873
Amends Penal Code §832.7 to prohibit disclosure of peace officer personnel records or information obtained from these records by anyone. Previously, this section just prohibited disclosure by "the Department or Agency that employs the peace officer."
AB 1982
Amends Labor Code §4850.4 making it mandatory (was discretionary) for cities and counties to provide advanced disability payments after the 4850 time has run and the officer is waiting a disability retirement.
AB 2023
Amends the Government Code to allow deputy district attorneys and public defenders to be included in PERS safety retirement, if negotiated with the employing agency.
AB 2040
Modifies Evidence Code §1043 to provide the requirement for a Pitchess Motion to obtain personnel records of custodial officers.
AB 2238
Amends Government Code §6254.21 to prohibit any person from knowingly coasting a peace officers spouse or child's home address or telephone number on the internet with the intent to cause or threats of great bodily harm.
AB 2846
Adds 3312 to the Government Code prohibiting an employer of a public safety officer from taking punitive action against an officer for wearing a pin or displaying any other item containing the American flag unless the employer gives the officer written notice that the wearing of such item violates an existing rule or regulation. The officer may then file an appeal against the employer challenging the alleged violation.
AB 2909
Amends Government Code §20463 to require a public employer who requests a quotation from PERS affected employee organizations within five days of receipt of the quotation from PERS.
SB 1516
Amends Government Code §3309.5 to provide additional remedies in a form of civil penalty up to $25,000.00, actual damages and attorney's fees to officers who prove a violation of their rights under the Public Safety Officers Procedural Bill of Rights Act with malice and an intent to injure the public safety officer. (See enclosed article).
SB 1637
Amends Government Code §50089 to disqualify any employee organization primarily comprised of peace officers which represents less than 7,000 retired or active peace officers that is not filed with the Secretary State an agent of the employee organization that has been designated for purposes of service of process before December 31, 2002 disqualifies such organization or its affiliated groups from utilizing a provision in the Meyers-Milias-Brown Act, which allows a bargaining unit to be comprised of solely peace officers until January 1, 2007. File your notice of service of process with the Secretary of State before December 31, 2002.
SB 2094
Amends Government Code §21023.5 to allow a public agency to amend its contract with PERS to provide that employees may purchase up to three years of volunteer service in the Peace Corps, VISTA (Volunteers And Service To America), or
Americorps.
